What's more, laws can vary from region to region. In the Costa del Sol, for example, a landlord who plans to rent out a flat on a short-term basis must obtain registration in the Andalusian tourist register and comply with numerous requirements.

These include:

  • making available to guests a book of complaints and grievances,
  • air conditioning and heating,
  • blackout blinds fitted in the bedrooms.

One more important issue remains: renting a flat in Spain versus taxes in Poland. The answer is Article 3(1) of the Personal Income Tax Act, which clearly stipulates that every tax resident is obliged to settle all income in Poland, regardless of whether it was earned in the country or abroad.

As it turns out, it is not always necessary to settle twice with the tax authorities for renting a flat. Spain has signed a double taxation treaty with Poland, which has been in force since 1 January 2023. Thanks to it, the taxpayer must, of course, show foreign income in the PIT-28 form, but if the tax paid in Spain is higher than that in Poland, it does not have to be paid again in the country.
